Are there any penalties for late filing ACA Forms 1095-B/1095-C?

Businesses that miss the filing deadline and/or fail to file accurate forms are subject to IRS penalties. There is also a possibility of penalties if the business files paper forms, but was required to file electronically.

The penalty rate will vary depending on the size of the organization.

  • For 1095-B: Penalty fees can range from $50 to $536,000.
  • For 1095-C: $310/ return with the total penalty for a calendar year not exceeding $3,783,000.
